Welcome to VibeCall.io (the “Service”). These Terms & Conditions (the “Terms”) govern your access to and use of our website, web and mobile applications, and related communications services. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Eligibility & Account Registration
- You must be of legal age to form a binding contract in your jurisdiction.
- When you create an account, you must provide accurate and complete information and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account.
2. Use of Services
VibeCall.io provides prepaid voice calling and related features. You agree to use the Service only for lawful purposes and in accordance with applicable local, national and international laws and telecommunications regulations.
- Do not use the Service to send spam, unsolicited robocalls, phishing, or fraudulent traffic.
- No auto-dialers, predictive dialers, war dialers, or high‑volume call blasting unless expressly permitted in writing.
- Do not spoof caller IDs unlawfully or misrepresent your identity.
- Respect destination country rules (e.g., recording consent, restricted prefixes, Do‑Not‑Call lists).
3. Purchasing Credits and Billing
- Calling generally requires purchasing credits in advance. Prices, fees, taxes and exchange rates may apply.
- Payments are processed by PCI‑DSS compliant providers; we do not store full card numbers.
- Usage deducts from your credit balance per the applicable rate at the time of the call and applicable connection or service fees.
- Credits may have expiration periods where permitted by law; promotional credits may have additional terms.
- Taxes/VAT: You are responsible for any applicable taxes; we may collect and remit as required.
4. Call Quality and Availability
We strive for reliable, high‑quality calls. Actual quality may vary due to factors including recipient network, device, routing conditions, and internet connectivity. Service may be temporarily unavailable for maintenance, updates, outages or partner issues. We do not guarantee uninterrupted or error‑free operation.
5. Emergency Services Limitation
The Service may not support access to emergency calling (e.g., 112/911/999) or may provide limited functionality. You must maintain an alternative means to reach emergency services. By using the Service, you acknowledge and agree that VibeCall.io is not a replacement for traditional telephone services and is not required to offer emergency calling in all locations.
6. Refunds and Chargebacks
Important: VibeCall.io is a prepaid VoIP service. Purchased credit is generally non‑refundable once used. Unused credit may be eligible for a refund within 14 days if no calls were made. Duplicate or fraudulent transactions will be refunded in line with card‑scheme rules.
6.1 Right of withdrawal (EU/UK)
- Consumers in the EU/UK normally have a 14‑day right of withdrawal for digital services. By purchasing credit/top‑ups you request immediate service delivery. You agree that the service may start immediately and that the withdrawal right is waived once any credit is used (e.g., a call is placed).
- If you have not used any of the purchased credit and no calls were made, you may request a withdrawal within 14 days of purchase for a refund to the original payment method.
6.2 Refund eligibility
- Used or partially used credit: No refunds.
- Unused credit: Refundable within 14 days if no calls were made and no portion of the credit was consumed.
- Duplicate/erroneous charges: Fully refundable.
- Technical fault preventing usage: If a verified platform fault prevented reasonable use after purchase, we may refund unused credit or re‑credit your VibeCall balance.
- Fraudulent/unauthorised transactions: Reversed/refunded in accordance with card scheme and PSP rules (e.g., Visa/Mastercard, Stripe, Paysera, Revolut).
- Promotional/bonus credits and expired balances: Not refundable.
6.3 How to request a refund
- Email info@vibecall.io within 14 days of purchase and include: account email/phone, receipt/transaction ID, purchase date, amount/currency, and a brief reason.
- Where approved, refunds are issued to the original payment method. Processing times depend on your bank/PSP (typically 5–10 business days).
6.4 Billing errors
- If you believe there is a billing error, email info@vibecall.io within 30 days with details (receipt, call time, destination).
- Where we verify an error on our side, we may correct it by adjusting your VibeCall credit balance or issuing a refund where applicable.
6.5 Chargebacks
- Please contact us before raising a chargeback so we can help. Unfounded chargebacks may lead to account suspension and recovery of fees/costs. We will always comply with card‑scheme rules.
6.6 Payment processors
- We use reputable payment service providers. They require a published refund policy and enforce their own dispute rules. Even if our policy says no refunds for used credit, card‑scheme chargeback rules still apply and will be followed.
7. Fair Use & Prohibited Conduct
- We may apply reasonable usage policies to prevent fraud, abuse, or network harm.
- Prohibited: illegal content; harassment; infringement; bypassing usage controls; reverse engineering; reselling the Service without consent.
8. Caller ID and Number Presentation
We may present your verified number as caller ID where supported. You must not manipulate caller ID to deceive or harm recipients, and you must comply with applicable regulations regarding number presentation.
9. Recording and Monitoring
If you use any recording features or record calls on your device, you are responsible for obtaining all required consents under applicable laws. We may monitor or retain certain metadata (e.g., CDRs) to operate and secure the Service and comply with law.
10. Intellectual Property
- All content and software are owned by VibeCall.io or its licensors and protected by intellectual property laws.
- We grant you a limited, revocable, non‑exclusive, non‑transferable license to use the Service for personal, non‑commercial purposes.
11. Privacy
Your use of the Service is subject to our Privacy Policy, which explains how we collect, use and protect your data. Please review it at /privacy/.
12. Third‑Party Services and Links
The Service may link to or integrate with third‑party services. We are not responsible for their content, policies, or practices. Your use of third‑party services is at your own risk.
13. Disclaimers
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not warrant error‑free, secure or uninterrupted operation, nor specific call quality to any destination.
14. Limitation of Liability
To the maximum extent permitted by law, VibeCall.io and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or loss of profits, data or goodwill, arising from or relating to your use of the Service. Our aggregate liability for all claims in any 12‑month period shall not exceed the amount you paid to VibeCall.io for the Service during that period.
15. Indemnification
You agree to indemnify and hold VibeCall.io harmless from any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your use of the Service or violation of these Terms.
16. Termination and Suspension
We may suspend or terminate your account or access to the Service at any time, with or without notice, for suspected fraud, abuse, unlawful activity, non‑payment, or violation of these Terms. Upon termination, unused credits may be forfeited where permitted by law.
17. Changes to the Service or Terms
We may change the Service or these Terms at any time. We will post updates on this page and adjust the “Last updated” date. Your continued use after changes take effect constitutes acceptance of the updated Terms.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of Scotland, United Kingdom, without regard to conflict of laws principles. Courts located in Scotland shall have exclusive jurisdiction over disputes, unless both parties agree in writing to binding arbitration administered by a recognised arbitration body seated in Scotland.
19. Severability; Entire Agreement; Waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in full force. These Terms are the entire agreement between you and VibeCall.io regarding the Service and supersede prior understandings. Our failure to enforce a provision is not a waiver of our right to do so later.
